In Poland, legal succession is organised in orders. Firstly, the children of the deceased and their spouse inherit alongside each other and with equal rights. However, the surviving spouse's share of the estate may never be less than a quarter (Art. 931 § 1 ZGB). This rule only has an effect if there are more than three children. If a child has predeceased the spouse, his or her share of the inheritance goes to his or her children.
Only if there are no descendants do the surviving spouse and the parents of the deceased inherit alongside each other and in equal shares, Art. 932 § 1 ZGB.
