There is a ban on joint wills in Spain. According to Art. 669 CC, Spaniards are prohibited from drawing up such a will. However, a different approach may be required within the scope of the EU Succession Regulation. You can find further information in our article on Admissibility of inheritance contracts and joint wills in Europe.
In common Spanish law, inheritance contracts are also prohibited, Art. 1271 CC. However, various formal laws expressly authorise them. Here, too, it is necessary to check carefully whether a formal law is applicable. If you have any further questions, your specialist inheritance lawyer in Düsseldorf and Krefeld, Dr Michael Gottschalk, is at your disposal.
