Are German wills valid abroad?

QuestionThe testator died abroad. When he was still living in Germany, he made a will. Is this now also valid abroad?

AnswerFirstly, it depends on whether the country in question is a member state of the EU or a so-called third country. If it is a member state of the EU, wills drawn up in Germany are also valid in the other state. Nevertheless, it is necessary to check in each individual case whether the constellation devised by the testator is possible in the country in question or whether adjustments may need to be made.

It is more difficult with third countries. Here it depends, among other things, on whether international agreements have been concluded between the countries concerned.
