An inheritance can only be expressly disclaimed in a notarial deed. If it is unknown whether the estate is over-indebted, acceptance subject to the preparation of an inventory pursuant to Articles 793 et seq. of the Swiss Civil Code (ZGB) is also possible. In this case, the heir is not liable for the estate's debts with their personal assets. After the corresponding declaration, a notarized inventory must be submitted, and the creditors enter their claims. The heir accepting the inheritance subject to reservation must then manage and liquidate the estate to satisfy the liabilities, as per Article 803 of the Swiss Civil Code (ZGB).
